License agreement for timeEdition
1. Upon acquisition of a Licence, we grant the customer in case of doubt a personal, non-exclusive, simple right of use with respect to the software in accordance with the Licence Agreement and these General Terms and Conditions.2. The Licence shall apply in case of doubt and subject to the additional, following regulations for use on a workstation (PC or other computer for simultaneous use by one person), and in the case of software intended for use on a server, for use on a server.
3. The licence for timeEdition shall apply to the installation on a fixed workstation and up to three further mobile devices of the same user. timeEdition pocket entitles to the use of the software on the provided USB-stick by a natural person on any number of PCs. timeEdition portable entitles to the installation and use on USB-Sticks or mobile storage device by a natural person on any number of PCs. timeEdition Pro shall apply to the installation of the server program on a server and for the administration of the data of the stated number of employees. For this purpose, the client program for recording the time data may be installed in each case per employee at one fixed workstation (PC) and up to three additional mobile devices of the same user. We shall be entitled to make the server installation dependent on a release after registration and entry of the data of the Licensee (name and address) in our licence database. For the release, a registration number will be required, which can be awarded individually for each licence, for licence packages or for the customer generally.
4. Within the context of the use permitted, the client shall be entitled to make any copies required. This shall in particular apply also to a backup copy of the installation files and the customary backups of the installed files, but not to the installation on several computers for alternating use. In the event of the resale of the licence, all remaining copies must be deleted. With regard to not directly executable, integrated backups of the installed files (images), this shall only apply in the case of the restoration of the executable system. The backup copies may only be internally available to the extent required.
5. The customer may not remove, cover, or in any other way wholly or in part suppress on either the software or on any data carriers included in the delivery or documentation or other documents provided references or notes concerning copyright-, patent-, company-, name-, symbol- or other trademark rights.
6. The client shall only be permitted within the arrangements of the licence agreement to alter or supplement the source code of the software. This shall not affect the rights of the client under Articles 69 d, 69 e of the German Copyright Act [Urheberrechtsschutzgesetz, UrhG] as well as under any other regulations referred to in these regulations.
7. We shall be entitled to cancel the licence for good cause. Good cause in particular refers to a material infringement of the limits of the licence granted, unauthorised distribution or making copies of the software available to the public or any other unauthorised distribution.
8. The licence shall be transferable within the area where an exhaustion of the copyright occurs (Article 69 c subsection 3 of the German Copyright Act), if a data carrier is sold, otherwise only with our permission or pursuant to the provisions of the Licence Agreement. In the event of a change of the Licensee, the data of the purchaser must be communicated to the Licensor by the seller in writing. The purchaser must also be given the registration number. In the case of collective registrations the purchaser shall only have bee entitled to have a new registration number issued if the individual sale of the licence was permissible. Leasing transactions shall require a special licence.
9. The download or purchase of a demo version does not imply to the acquisition of a licence in the meaning of a copyrighted right of use. We merely grant the right of use subject to revocation for test purposes within the context of the regulations relevant for the demo version. The alteration of the source code and the bypassing of the technical limits of the demo version shall not be permitted.
